All services provided by MarkScudder.com or its associated and related services, products, and interests (hereafter referred to as "The Website") may be used by you (hereafter referred to as "The Visitor") for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material The Owner judges to be threatening or obscene, any material that The Owner judges may damage the character of The Website or The Owner, or material protected by trade secret and other statute. The Website is owned by Mark David Scudder (hereafter referred to as "The Owner"). The Owner has set forth specific guidelines in its interest.

Access to The Website and any related services is denied to the following individuals for violations of these Terms and Conditions or other previous action deemed to be harmful to The Owner or The Website. This may not be a comprehensive list and is subject to change without notice. The individuals listed below may not access this website or any associated service of this website at any time or for any reason:

Philip A. McGovern, Catherine Ann Clark, or anyone accessing The Website on their behalf for any reason.

Additionally, a group of individiuals comprising Michael H. Saltzman, Robert Glass, Amanda Addoroloto, Claire Mechmann, Michael Mechmann, Taryn Alper, Rebecca Dinhofer, Ilona Kotik, Katelyn Manton, Patrick Maguire, Carolyn De Melo, Abby Millberg, Sam Yaggy, and Rachel Tarlow, who are further identified as being students of the State University of New York ("SUNY") at Binghamton (also known as "Binghamton University") as of February 2008, or anyone accessing The Website on their behalf for any reason.

Limitation of Liability

The Owner shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from servers going off-line or being unavailable for any reason whatsoever. Furthermore, The Owner shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from your use of this website or any services associated with it.

Violations

Violations of these Acceptable Use Policies should be referred to mark@markscudder.com. All complaints will be investigated at the sole discretion of the Owner. Failure to follow any term or condition will be grounds for immediate access denial.  Violations of law, and access by individuals listed in the section "Specific and Current Refusals" will be prosecuted to the fullest extent of the law.
